Waste Removal Uxbridge Terms and Conditions

These Terms and Conditions set out the basis on which Waste Removal Uxbridge provides waste removal and related services to domestic and commercial customers. By booking a waste collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the following meanings.

Customer means the person, business or organisation that requests and pays for the service.

Service means the collection, loading, transport and disposal or recycling of waste materials and any related services provided by us.

Waste means any items, rubbish, junk or materials that the Customer asks us to remove, including household, garden, commercial and construction waste, subject to the exclusions set out in these Terms and Conditions and any applicable waste regulations.

We, us and our mean Waste Removal Uxbridge, the service provider.

Site means the property, premises or location where the waste is to be collected or where any related service is to be carried out.

2. Scope of service

We provide waste removal and waste collection services in Uxbridge and surrounding areas, including the loading, removal and lawful disposal or recycling of waste. The specific details of the service, including the type and volume of waste, the access arrangements and the date and time of collection, will be confirmed at the time of booking.

We reserve the right to refuse to collect any waste that we reasonably believe is hazardous, prohibited, unsafe to handle, not as described at the time of booking, or not in compliance with applicable laws or regulations. We may also refuse service where access is unsafe or significantly different from what was described during the booking process.

3. Booking process

Bookings can be made by phone, email or online enquiry. When making a booking you must provide accurate and complete information about the waste to be collected, including but not limited to the type of waste, estimated volume or weight, access details to the Site and any parking restrictions.

Quotes are usually based on the information you provide and on our standard pricing for the type and amount of waste and the location. Any quote given prior to our arrival is an estimate only and may be revised if, on arrival, the actual waste type, quantity or access conditions differ from those described.

Your booking is only confirmed when we have accepted it and provided you with a confirmation, which may be given verbally or in writing. We reserve the right to decline a booking at our discretion.

4. Access and customer responsibilities

The Customer is responsible for ensuring that we have safe, reasonable and lawful access to the Site at the agreed date and time. This includes arranging any necessary parking, permits, keys, codes or authorisations required to enter the Site or nearby roads.

The Customer must ensure that the waste is clearly identified and is either pre-assembled in a suitable area for collection or made available as agreed during the booking. The Customer must also ensure that any waste to be collected is not contaminated with hazardous substances or prohibited materials.

If access is delayed, restricted or unsafe, we may charge for waiting time, an additional visit or any extra labour required, or we may cancel the service and apply our cancellation or wasted journey charges as set out in these Terms and Conditions.

5. Pricing and quotations

Our pricing for waste removal services will typically be based on a combination of factors including the type and volume of waste, loading time, labour required, distance, parking and disposal or recycling costs.

Any quotation given prior to arrival is provided in good faith based on the information supplied by the Customer. If upon arrival it becomes apparent that the job is materially different in scope, volume, type of waste or access conditions, we may revise the price accordingly. In such circumstances, you will have the option to accept the revised price or decline the service before work begins. If you decline the revised price after we have arrived on Site, a call-out or wasted journey fee may apply.

All prices are stated in pounds sterling and, where applicable, inclusive or exclusive of VAT as communicated at the time of booking. We reserve the right to change our pricing at any time, but changes will not affect bookings already confirmed.

6. Payments and invoicing

Payment is due on completion of the service, unless otherwise agreed in writing. For most residential waste removals, payment must be made immediately upon completion of the job at the Site.

We accept common payment methods such as cash, debit card, credit card and bank transfer, subject to confirmation at the time of booking. We do not accept cheques unless specifically agreed in advance.

For business customers with approved credit terms, invoices are payable within the period stated on the invoice. If no period is stated, payment is due within 14 days from the invoice date. We reserve the right to charge interest on late payments at the statutory rate and to recover reasonable costs incurred in pursuing overdue sums.

Ownership of any waste passes to us only once the agreed payment has been received in full, and subject to the waste being lawful for us to collect and handle.

7. Cancellations, amendments and waiting time

You may cancel or amend your booking by contacting us as soon as possible. Where you cancel a booking more than 24 hours before the scheduled collection time, no cancellation charge will normally apply.

Where you cancel within 24 hours of the scheduled time, or if we arrive at the Site and are unable to carry out the service due to reasons beyond our control, we may apply a cancellation or wasted journey charge to cover our reasonable costs, including travel, time and any non-refundable expenses.

If you are not present at the agreed time, or if access to the Site is delayed, we may charge waiting time at our prevailing rates. If the delay is significant, we may need to rearrange the service and treat the original visit as a cancelled or wasted journey.

We may cancel or reschedule a service due to operational reasons, severe weather, safety concerns, vehicle breakdown, staff illness or factors beyond our reasonable control. In such cases we will endeavour to contact you as soon as possible to arrange an alternative time. We will not be liable for any loss arising from such cancellation or rescheduling, save for refunding any amounts you have already paid for services not provided.

8. Waste regulations and prohibited items

We operate in compliance with applicable waste management and environmental regulations. We will only collect and transport waste that we are lawfully permitted to handle. Certain types of waste are restricted or prohibited, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, oils, fuels, pressurised containers, explosives, radioactive materials and any other hazardous or special waste that requires a specific licence or treatment process we do not hold.

The Customer is responsible for informing us in advance of the nature of the waste to be collected. If hazardous or prohibited waste is found within the load, we may refuse to collect it, segregate it from other items, or return it, and we may charge additional fees to cover any extra handling, disposal, cleaning or regulatory requirements.

By using our service, you confirm that the waste presented for collection is not stolen and that you have the legal right to dispose of it. You also confirm that you have read and understood any local waste rules that apply to your premises and that our collection of your waste will not put us in breach of any such rules.

We aim to recycle or recover as much collected waste as is reasonably practicable. However, we do not guarantee that any particular item will be recycled, and the final treatment route will depend on the nature of the waste and the facilities available.

9. Liability and limitations

We will carry out our services with reasonable care and skill. If we cause damage to your property as a direct result of our negligence, we will, at our option, repair the damage or pay the reasonable cost of repair, subject to the limitations set out in this section.

We will not be liable for any pre-existing damage or defect, for damage arising from defective or unsafe access routes, or for damage caused by the movement of items through confined spaces where you have requested that we proceed despite the apparent risk.

Our total liability to you for any loss or damage arising from or in connection with the service, whether in contract, tort, negligence or otherwise, shall be limited to the total price paid or payable for the specific service giving rise to the claim. We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

We will not be liable for any indirect or consequential losses, including loss of profit, loss of business, loss of opportunity, or any similar economic loss, arising out of or in connection with the service, even if such loss was reasonably foreseeable.

10. Customer indemnity

The Customer shall indemnify us and keep us indemnified against any claims, losses, damages, costs, fines or expenses incurred by us as a result of the Customer providing incorrect or misleading information, presenting unlawful, hazardous or prohibited waste for collection, or otherwise breaching these Terms and Conditions or any applicable law or regulation.

11. Delays and events beyond our control

We will not be responsible for any failure to perform or delay in performing our obligations where such failure or delay results from events or circumstances beyond our reasonable control. These may include extreme weather, traffic disruption, accidents, road closures, public disturbances, fire, flood, industrial action, breakdown of equipment or vehicles, or legal or regulatory changes.

Where an event beyond our control occurs, we will take reasonable steps to minimise the impact and to resume the service as soon as reasonably possible. If the delay is substantial, we may need to cancel or rearrange your booking.

12. Complaints and disputes

If you are dissatisfied with any aspect of our service, you should contact us as soon as possible, providing full details of your concerns. We will investigate your complaint and seek to resolve it promptly and fairly.

If a dispute arises that cannot be resolved between us through our standard complaints process, either party may consider using alternative dispute resolution methods or take legal action as permitted by the governing law set out below.

13. Data protection and privacy

We will collect and process personal information about you only as necessary to manage bookings, provide our services, process payments and communicate with you. We will handle your information in accordance with applicable data protection laws and will take reasonable steps to keep your data secure.

We may keep records of completed jobs, including your contact details, for regulatory, accounting and operational purposes. You may have rights to access or correct your personal data, subject to legal limitations, and you can contact us to exercise those rights.

14. Changes to these terms

We may update or amend these Terms and Conditions from time to time to reflect changes in our services, pricing, business practices, legal requirements or for any other reason. Any such changes will take effect when published or notified and will not apply retrospectively to services that have already been completed.

For ongoing or future bookings, the version of the Terms and Conditions in force at the time of confirmation of the booking will apply, unless we notify you of a change and you continue to use the service.

15. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be deemed deleted, but the remaining provisions will continue in full force and effect.

16. Governing law and jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with any waste removal service provided by us, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our waste collection and removal services.

By placing a booking with Waste Removal Uxbridge or by allowing us to carry out any waste removal service, you confirm that you have read, understood and agreed to these Terms and Conditions.
